Yair skalsky - Law Office has been practicing medical law, medical malpractice and patients’ rights for 12 years. Adv. Skalsky, who is a member of the Israeli Bar Association’s Torts Forum and The Israeli Medicine and Law Association and counsels various associations and organizations on medical law, founded the Office with the aim of representing medical malpractice victims and individuals whose rights were violated during medical treatments, and this is the Office’s main Practice area. Another Practice area is in the claims to receive funding for complex medical procedures in Israel and abroad.
While medical malpractice laws are part of the general torts laws, this is a special subset that requires a particular understanding, both of the law and of medical and administrative processes, which occur in the complex doctor-patient relationship.
The main medical malpractice cases are late diagnosis of severe illnesses, erroneous management of obstetrics tracking, and surgical errors in plastic, orthopedic and other surgeries. Medical law is not part of the medical realm and the decision whether there was malpractice in a certain case is a legal decision rather than a medical one. Each case is complex and includes different angles and almost no case is similar to any next. The management process of medical malpractice cases requires an exact preparation and an accurate legal recognition of the grounds of the lawsuits.
